TERMS OF SERVICE
GENERAL
It is agreed that the terms set out in this booking form is the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing. By signing the wedding booking form, the bride & groom and/or their authorised agents, assign Rhondell Uzomah (hereafter known as “The Photographer”) exclusive rights to photograph the wedding outlined on the booking form.
BOOKING FEE
A non refundable deposit of £300 is required after the client signs this contract and receives their invoice. Dates are reserved only when this deposit is paid by online bank transfer.
PAYMENTS
Following payment of the booking fee, half of the remaining balance is due half way between the date the contract has been signed and the wedding date.The final balance for the photographic services is due to be paid at least fourteen calendar days prior to the date of the Wedding.
E.g. Wedding date 20th May 2020 - Package £1500 - Contract signed and deposit paid (£300) on 10th April 2019 - Half way payment (£600) due 25th October 2019 - Final payment (£600) due 6th May 2020.
SPECIAL REQUESTS/ COVERAGE
The Client understands and accepts that the photographic coverage will be as the Photographer’s professional expertise determines. Every effort will be made to honour special request instructions agreed in advance, provided time and weather permit and the availability and co-operation of the person/s concerned. Coverage will also be dictated by any restrictions imposed by the officials controlling the venue. The booking does not include the supply of press prints to publicise the wedding. However, the Photographer will, at his/her discretion, attempt to meet reasonable requests. The Photographer shall be granted complete artistic licence to include the poses photographed, locations used and processing of images. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested.
CO-OPERATION
All parties agree to provide as full cooperation as is reasonable to ensure the best possible outcome of the day, both prior to and during the event. Family and friends are permitted to take photographs as long as they do not disturb, disrupt or interfere with the photographer’s duties. The Photographer will not be held liable where such disruption results in their inability to discharge their duties pursuant to this agreement.
THE PHOTOGRAPHER
On occasions and without notice, it may be necessary for the Photographer originally specified to be substituted by another photographer, (e.g. due to ill health).
IMAGES
All image sizes are nominal. The Photographer will provide a pleasing colour balance but cannot guarantee exact colour matching owing to the technical limitations during processing and papers used. It is sometimes impossible to record in print the exact colour as seen by the human eye. The photographer may also use techniques to capture a specific effect.
RETOUCHING
The photographer will use his/her judgement in utilising basic retouching and image manipulation where appropriate. The Photographer reserves the right to deal with specific requirements as additional work.
COPYRIGHT
Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image created as part of this contract without the permission of the Photographer in writing. The Photographer retains all copyright and reserves the right to use images for the promotion of herself or her business without recourse or compensation to the client.
DIGITAL FILES
Where digital files have been provided as part of the order, they will be provided on an online gallery as JPEG files and will be available for up to 1 year. Online galleries are made available 10-14 weeks post wedding. The Photographer is not liable for any incompatibility that may be incurred in playing back such images due to the client’s equipment nor the visual presentation of prints obtained from such files owing to the incorrect use of colour profiling on the client’s or third party’s equipment. Copyright of the Photographer extends to such digital images though a licence is granted to the Bride & Groom (or client placing the order) to use them for their own personal use where no monetary gain is involved.Personal use includes, printing images from the file, copying files as a means of securing a backup, publishing images to a non commercial web site and the distribution of images for non monetary gain, e.g. to friends and family. The copying or distribution of files, images and discs outside of this licence is in contravention of copyright.
FORCE MAJEURE
The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control. If the photographer cannot perform this agreement due to a fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to photographers illness, then the photographer shall return the deposit and fees paid in full to the client but shall have no further liability with respect to the agreement. This limitation on liability shall also apply in the event that photographic materials are damaged or lost through camera or equipment malfunction, lost in the post, or otherwise lost or damaged without fault on the part of the photographer. In the event the photographer fails to perform for any other reason, the photographer shall not be liable for any amount in excess of the retail value of the clients order.
CANCELLATION
The Client may cancel this contract at any time by giving written notice to the Photographer but in doing so shall forfeit any monies paid. If the Photographer is forced to cancel the agreement then any fees and deposits will be reimbursed in full to the client.
COMPLAINTS
Any complaints should be raised by the Client with the Photographer, in writing, within 28 days of first becoming aware of the matter to be complained of and in any event within 28 days of receipt of the images.
UNEDITED/ RAW DIGITAL FILES
Unedited/ raw photos remain with the photographer for up to 6 months. At no point will these be released to the client. Only edited images are to be given to clients as they are the finished product.
ARCHIVE IMAGES
The Photographer cannot guarantee to secure copies of the images for ever; images will be retained by the Photographer for a minimum of a year after the event.
By filling out and submitting this form you agree to these terms of service and have signed a contract.
